Terms & Conditions

Booking Policy:
To finalize a booking guests must complete a credit card transaction. Our credit card processor is stripe.com, Level 1 PCI compliant. Full payment is due at the time of booking unless otherwise agreed upon with the host. Contact us using the form on this site if you have concerns.

Cancellation Policy:  
Guests may cancel their reservation up to 90 days before the check-in date for a refund, minus a 10% transaction fee. Between 90 and 45 days prior to check in, we will refund 1/2 of your payment. Cancellations made within 45 days of the check-in date are non-refundable. Your cancellation must be requested through this website’s contact form.

Check-in/Check-out Policy:
Check-in is at 4:00 PM on the day of arrival, and check-out is at 10:00 AM on the day of departure. Early check-in and late check-out may be available upon request but are subject to availability and may accrue additional fees.

Occupancy Policy:
The maximum number of guests allowed in each unit is specified on the booking page. (16 for the villa, 8 for the big house, 4 for the Casita, and 4 for El Nido.) Additional guests may be allowed upon request and are subject to additional fees.

Owner Responsibility and Rights:
Melissa and William Roberts and their agents and employees are responsible that the property is well maintained and that any necessary repairs are done in a timely fashion. The Owners or their employees shall have the right to enter the premises at any reasonable time during the term of this Agreement to clean, maintain, and inspect the property and perform such duties and responsibilities as necessary.

Damages and Liability:
Guests are responsible for maintaining the property in a clean and tidy condition throughout their stay. Any damages or maintenance issues must be reported to the Owner/Manager immediately. Guests are responsible for any damage caused to the property or its contents during their stay. The host reserves the right to charge guests for any damages or excessive cleaning required.

The Owner/Manager is not liable for any injuries, accidents, or losses that occur on the property. Guests are advised to obtain travel insurance to cover any unforeseen circumstances during their stay. The Guest agrees to indemnify and hold harmless the Owner/Manager from any claims, damages, or liabilities arising from their use of the property. Guests agree not to engage in any illegal activities on the premises.

The premises include two pools and other facilities that present inherent risks of injury.  Guests accept these risks and waive and release the Owners or their employees from any claim for any personal injury or property damage suffered while occupying the Property.

Smoking and Pet Policy:
Smoking is not permitted, and pets are not allowed.

Parking:
Guests are requested to park all vehicles either in the cochera (the parking area) or on the left (east) side of Calle Higueras, being careful not to block access to our neighbor’s garage.

Noise and Disturbance Policy:
Guests are expected to respect the privacy and comfort of other guests and neighbors. Loud music and parties are not allowed on the property. Please observe quiet hours after 10pm and before 9am.

Security Deposit:
A security deposit may be required at the time of booking or check-in to cover any damages or violations of the rental agreement.

Governing Law:
The laws of the State of Nayarit, Mexico shall govern the validity, performance and enforcement of this Agreement.  In the event The Guest(s) seek recourse against the Owners for any event occurring within the Premises, they shall be under the jurisdiction of the laws and courts of the municipality of Bahia de Banderas, Nayarit, Mexico. The parties renounce all other jurisdictions present or future.

By making a booking, guests agree to these terms and conditions and any additional policies or rules specified by the host. The host reserves the right to modify these terms and conditions at any time without notice.
